By using the Eclipse Ski website you accept that you agree to the following terms and conditions. The Eclipse Ski website may be modified at any time. Your continued use of the site will constitute as acceptance of such terms whist using this website.
Definitions and Related Matters
1.0 In Writing
In writing means by Facsimile, Letter or E-mail. We accept no liability if written communication is not received.
Any communication whatsoever made by e-mail (including cancellations and changes) will only be deemed to have been accepted by us once you have received a return e-mail from Eclipse Ski confirming your actions.
3.0 The Booking
The booking means and includes all bookings made on behalf of a client by us, including but not exclusively hotels, chalets, apartments, flights, transfers, activities, ski hire, ski passes and skiing lessons.
4.0 You and Your
In each case this refers to all persons named on the booking made with us, including any additional persons who are added or substituted at a later date.
5.0 We, Us and Our
In each case this refers to Eclipse Leisure Ltd.
6.1 When making a booking is with Eclipse Ski, your legal contract is binding with your airline or tour operator specified on your confirmation receipt. Eclipse Ski acts only as your booking agent. Airlines and tour operators will have their own booking terms and conditions, it is essential that you read these.
6.2 If you have any special requirements, Eclipse Ski will notify the tour operator, but under your tour operators booking conditions, they cannot be guaranteed.
6.3 Any changes or amendments to your holiday, including name changes, may result in a fee. We will do our utmost to make these changes, but they may not always be possible. Any changes or amendments to your skiing holiday must be received in writing.
6.4 The lead passenger on the booking will be liable for the full balance of the holiday. The lead passenger must be 18 years of age or over.
6.5 A booking is only confirmed once an e-mail confirmation has been issued from Eclipse Ski. If you do not receive a confirmation e-mail, or any details appear to be incorrect or incomplete please contact Eclipse Ski as soon as possible. Eclipse Ski acts as an agency and therefore is exempt from any responsibility for errors in documentation, excluding when those errors are made by us.
When travelling abroad, you must hold a ten-year passport. Please ensure your passport is valid for the duration of your skiing holiday.
8.0 Visa Requirements
A visa may be required to enter the country you are travelling to. We recommend contacting the embassy of your destination country for any queries.
9.1 The lead passenger is responsible for ensuring the full balance in paid.
9.2 An initial deposit or any amount agreed is payable on booking. The deposit paid will be non-transferrable and non-refundable. Deposits are payable by credit or debit card. Eclipse Leisure Ltd reserves the right to change prices or cancel arrangements should the deposit not be received within the time outlined. The final balance for the holiday is payable 13 weeks prior to departure unless otherwise agreed in writing. Eclipse Leisure reserves the right to cancel the booking if the full amount is not received on time. This will result in the loss of all monies paid.
9.3 Any booking made within a 13 week period will be payable in full unless otherwise agreed by Eclipse Leisure Uk Ltd.
9.4 Eclipse Leisure Ltd reserves the right to require the balance in full for payments for all holidays taken at short notice, less than 13 weeks prior to departure.
9.5 Eclipse Leisure Ltd will not be obliged to dispatch any tickets or documents relevant to the booking until the balance for the skiing holiday has been paid in full. Eclipse Leisure Ltd reserves the right to cancel all or part of the holiday should payment not be forthcoming as per terms and conditions laid out in clause 9.2.
9.6 Eclipse Leisure Ltd will ensure that the client is fully aware of the holiday details at all times before any deposit is paid, however provisional flight times and the holiday package can only be confirmed on receipt of deposit.
9.7 Eclipse Leisure reserves the right to charge a fee of 2% for all credit card payments taken over the phone. Payments made with switch or debit cards will not incur this fee. Payments made online via the holiday mini website will incur a £4.00 flat fee.
9.8 Credit Card Security
If the correct debit or credit card billing address is not supplied, tickets may be delayed. We reserve the right to cancel the booking if incorrect card information has been supplied or payment has been declined. In compliance with credit card companies or security companies, we also reserve the right to conduct random checks.
9.0 Your money is protected
Eclipse Ski is ABTA bonded and ATOL registered. We are obliged to provide a high level of customer service, as per ABTA’s code of Conduct.
10.0 Third Parties
Whilst making arrangements on behalf of its clients, Eclipse Leisure Ltd contracts with third parties for provision of all the necessary facilities including the provision of tickets for airlines. In doing so it is expressly agreed that Eclipse Leisure Ltd acts only as agent of the client and that no liability of any kind howsoever caused shall attach to Eclipse Leisure Ltd in connection with or arising out of such arrangements. The contract between Eclipse Leisure Ltd and the client shall be subject to any terms and conditions of contracts with third parties. In the event that such facilities or tickets shall not be available, for whatever reason, any liability of Eclipse Leisure Ltd shall be limited to the return of all sums paid by the client for such facilities or tickets.
11.1 Every effort will be made by Eclipse Leisure Ltd to alter or change all or part of the holiday package on request of the lead passenger. Eclipse Leisure Ltd must be notified of any changes in writing. Costs incurred by Eclipse Leisure Ltd will be chargeable to the client; this includes reasonable administration costs which shall be agreed with the client before any changes are made.
11.2 Please note that any changes requested to be made to your booking will attract an administration fee to be agreed before proceeding with any changes.
11.3 Every reasonable effort will be made by Eclipse Leisure Ltd to adhere to confirmed arrangements, Eclipse Leisure Ltd reserves the right at its sole discretion to alter or change arrangements should it be found necessary to do so, and shall have no liabilities whatsoever to the client for any changes, save a refund of any monies not expended. Purchase of an airline ticket does not guarantee you a seat on a particular flight.
12.0 Reduction in numbers
12.1 Wherever possible we will always try and accommodate reduction in numbers incurring no cost. However should the numbers attending be insufficient to qualify for quoted group discounted prices, Eclipse Leisure Ltd reserves the right to charge the client for the minimum numbers required to continue with the booking for the holiday. Reduction in numbers will only be confirmed when you have received communication from Eclipse Leisure Ltd.
12.1 No reduction in numbers of people booking a skiing holiday can be accepted six weeks prior to an event unless other wise agreed in writing by Eclipse Leisure Ltd.
12.2 Invoices relating to dropped numbers will be dispatched by e-mail only. Eclipse Leisure Ltd will only commit to sending two invoices by post, one on booking and one on receipt of final numbers. Invoices can otherwise be dispatched to you free of charge via e-mail.
12.3 Please note that an uneven number of participants for your group will attract a room single occupancy supplement charge. It may be possible to book a triple room. Eclipse Leisure Ltd will do everything possible to avoid the single occupancy supplement.
13.0 Late Booking Fees
Late booking fees may be levied by the tour operator. They may be flight or room supplements added to the total balance.
Supplements may be added to bookings, including but not exclusively for flying from different departure airports other than London Gatwick, altering your baggage allowance, having a bath as part of en suite facilities, single occupancy rooms, having a balcony or adding ski carriage to your booking.
15.0 Website Promotions
Promotions on the Eclipse Ski website are subject to availability and only available for the duration of the promotion.
16.0 Website Content
All content and photos featured on the Eclipse Ski website are owned by us or our licensors and all rights are reserved. It is illegal to copy, publish or sell any information obtained from our site for commercial purposes.
The data supplied on the Eclipse Ski website is for information only. It is not definitive and you must satisfy yourself that all data is correct before you act upon it. If you decide to take part in winter sports, you do so entirely at your own risk. Skiing and snowboarding can be dangerous, and it is your personal responsibility to understand and accept the dangers before you participate. Eclipse Ski cannot be held liable for accident or injury sustained by any client.
18.0 Transport Delays
Circumstances beyond our control may cause delays to pre-arranged transport. This is the responsibility of the transport provider, therefore speak to the transport representative at the time of delay if you wish to make a compliant. Some travel insurance policies cover costs incurred during such delays, check your policy for details.
19.1 We strongly recommend that all of our customers take out Standard Travel Insurance that covers medical expenses, personal accident, loss of deposit and cancellation fees, damage, loss and theft of baggage etc.
19.2 Skiing can be dangerous, and your equipment valuable; it is important that you understand the extent of your cover, and consider further cover wherever appropriate as Eclipse Ski will not be held liable in any circumstances for any loss, damage or injury. It is worth noting that many credit card providers include travel insurance when you pay for your trip with your credit card. We recommend that you check with your credit card provider.
2.0 Refund Policy
20.1 The lead passenger or any named passengers on the booking may cancel the holiday arrangements at any time. Notification of cancellation must be received in writing, and is only confirmed once Eclipse Ski has confirmed receipt of the cancellation. The cost will be determined at time of cancellation.
20.2 Any insurance claims must be reclaimed directly with your insurer.
20.3 It may be possible to transfer names on the booking. Please note that some airlines will only have a non-refundable, non-transferrable tickets policy. All costs and charges levied will be passed onto the customer, together with an administration fee.
All timings (including flights) are provisional and subject to change under your tour operator’s terms and conditions.
22.0 Complaint Procedure
22.1 If at any time during your holiday, you feel unhappy with your arrangements, ensure to notify the tour operator immediately. If the situation has not been resolved between you and the tour operator and you are still unhappy you should contact us, Eclipse Leisure Ltd immediately on our emergency telephone number, which we will provide in advance.
22.2 If you wish to complain about your holiday, it must be received in writing within 28 days from the date of return. It is strongly recommended to communicate any complaints as soon as possible after returning from your holiday.
22.3 Your contract is with the tour operator. Please notify us of any complaints you wish to make. Having received the complaint we will pass it onto the tour operator. If you wish to complain about your booking with Eclipse Ski, we will thoroughly investigate the problem to the best of our ability. We are unable to investigate and resolve the problem if this procedure is not carried out. If you do not follow the complaints procedure set out in this section, compensation may be reduced or even lost altogether. If, in the unlikely circumstance that you have to pay for something you believe you have pre-paid for with us, you must collect a receipt and send it to us, so we can reimburse you for those costs. Please allow 28 days for a reply after sending your complaint.
We believe the above terms and conditions to be fair. This contract shall be governed by English Law and shall be subject to the sole jurisdiction of the courts. If you make a booking with Eclipse Leisure Ltd it is understood you have read, understood and accepted these terms and conditions.
It is the sole responsibility of any persons booking with Eclipse Leisure to communicate these terms and conditions to all participants of an event.
